VIRGINIA BEACH - - Around the globe and across the nation the sexual misdeeds by politicians - scandals and scoundrels - are making headlines and politicians in  Virginia Beach are not exemept. The list goes on and onAnd Time Magazine’s upcoming cover this week features all the sexual crimes and conquests of political power playing men - AKA pigs.

Political power players have problems with keeping their zippers up!  And loose zippers coupled with low self-esteem and out of control egos can lead to problems.

A young Virginia Beach woman (we'll call her Jane Doe)  has said a Virginia Beach city council member she claims has a porn addiction, illegally video taped her engaging in consensual sex with him back in the early 2000s.  She claimed she found a massive collection of porn material while she was living with the official.  It contained videos of her and other, some well known beach women, he’d dated.

She said she had never given anyone permission to tape her nude, engaging in sex, or photographging her in  full frontal nudity.

She said, “You can’t believe how scary it is walking around in the community and not knowing how many people have seen the videos of me.  To me this is a serious issue.   To him it was just a big macho conquest thing.”


Jane Doe  kept very detailed extemporaneous handwritten daily records of her involvement with the official.  She also made recordings and kept emails of all contracts over the years.  Following a 3 month investigation, she agreed to talk to VNS on conditions of anonynimity.

 

Jane was invovled with and lived on and off with the man in early 2000s.  Because of paranoia or fear he would distribute the videos and photographs, she wanted assurances they had been destroyed.  But often times pornographgers, like serial rapists and killers, like to keep items from victims for future pleasure.


In April 2006, Jane finally got him to give her a signed statement saying he had destroyed all copies of sexual material he had of her.  But  in April  he refused to give her  assurances  that he never published or distributed videos or photos through email or on the Internet of her engaging in sex or in the nude.

“However, after being assured he's destroyed the videos and data, I have subsequently found out that he lied about that.  Subsequent girlfriends and encounters have told me they had seen videos of me after he said he had destroyed them.  Of course I had seen videos of others (including threesomes) engaging in various sex acts photographed at his house,” she said.  “This is a nightmare that never ends.”

She added, “I want assurances that he never distributed anything involving me.”  

When he refused to respond to her written request about publication and distribution of material involving her, she sent an email to his Virginia Beach city council email address.  Attempts by others (not VNS) to obtain a copy of the email under the Virginia Freedom of Information Act has met with stonewalling behind questionable legal advice from the City Attorney’s office.

His other emails were released, but the one to him from Jane Doe asking for assurance he didn’t distribute the images was not among them.  

Virginia News Source will now attempt to uncover the emails.  According to the Virginia Public Records Act [VPRA], §§ 42.1-76 — 42.1-91, indexes must be maintained of all records and must be made available upon request.  After learning of the city’s refusal to release the emails, VNS asked City Freedom of Information paralegal Nancy Bloom:

1).  Who and under what legal authority (citation) was it determined which emails would and would not be released;
2).  Whether her office provided the citizen with the required 'index' of all emails as stipulated by code?  

In a response which she’d sent to the other person requesting release of the emails, she failed to answer either question and VNS still doesn’t know what public official made the decision on what emails wouldn’t and wouldn’t be released.  And the index question wasn’t addressed.

According to Bloom and the city attorney’s response to the previous FOIA, the email is being withheld because it has been declared ‘personal’ and private, not relating to ‘public service.’  One legal scholar told VNS that the term ‘public service’ has never been defined by national or state court case law, public statue, nor is it defined by public law or Black’s law dictionary.

Federal Judge Henry Hudson in the recent  Richmond extortion and bribery case against X-Peninsula Del. Phil Hamilton ruled that emails that Hamilton sent and received, even to his wife, with a taxpayer-owned server and computer were public record.

The woman said she is considering civil action against the councilman.  She recently attempted to file a criminal complaint, but learned the statute of limitations expired. Such photography and invasion of privacy crimes are only a misdemeanors when it involves an adult. If it involves an underaged child, it is a felony and there's no statute of limitations.

The official has hired Sonny Stallings, a beach lawyer, to try to ‘work something out with her,’ she said.

She is considering filing civil action against the man which could result in others being brought to court to testify.

She said she discovered a ‘secret’ bedroom closet camera one day while the official was at work.  She had seen quite a bit of pornographic or sexually - explicit materials, including still shots in albums and videos that were scattered around the house.  “He loved pornography,” she said.  

Curious how the videos had been acquired, she started poking around the house and discovered a large cache of porn in the attic and finally a camera hidden in a bedroom.

Virginia News Source is not identifying the official until it can contact him.  Other documentation and data will follow in subsequent stories.

I just sent off a check for $5,000.00 + or - to help support this sort of enterprise? No wonder these guys can't concentrate on lowering spending and taxes! So many diversions are vying for their attention. Is it possible that this will be the leak in the dike that leads to a real "clean-out" of the City of VB Council?

Why is it VNS not the Pilot gets these kinds of stories? You broke the story that dethroned Cong. Ed Schrock by exposing he was gay and the Pilot supposedly knew it all along, but did nothing. Why does it protect the perverts?

My major concern is that there are public officials sworn to serve the people that refuse to obey the law concerning freedom of information and open government. That in itself is a travesty. Those on council who have sworn their oath, should demand release of the information in the public's interest concerning public server information.
